Terms and Conditions
These terms set out how OAK & SOLE LTD sells footwear, provides fitting and repair services, and supplies trade customers. Please read them before purchasing or booking.
1. About us
This website, oakandsole.co.uk, is operated by OAK & SOLE LTD ("we", "us", "our"), a specialist footwear retailer trading from 105 High Street, Brentwood, CM14 4RR, England. Our director is Mr Paul Clint.
By using this website, purchasing goods from us, or booking any of our services, you agree to these Terms and Conditions. If you do not accept them, please do not use the site or place an order.
2. Definitions
- Goods — footwear, insoles, care products and related items we sell.
- Services — foot measuring, fitting consultations, adjustments, repairs, resoling, restoration and trade supply arrangements.
- You / customer — any individual or organisation purchasing Goods or Services from us.
- Consumer — an individual buying wholly or mainly outside a trade, business or profession.
- Business customer — an organisation or individual purchasing for business purposes, including trade and bulk orders.
3. Orders and formation of contract
Product listings, quotations and displays are an invitation to deal, not a binding offer. A contract is formed only when we accept your order — in store at the point of sale, or by written confirmation for special orders and trade supply.
Special and made-to-order items
Where we order stock in for you, we will confirm the model, size, width, price and expected lead time before proceeding. Lead times are estimates given in good faith and depend on supplier availability.
Order errors
If an obvious pricing or description error occurs, we may decline or cancel the order and will refund any sum paid in full. We will always contact you before doing so.
4. Pricing and payment
- Prices are in pounds sterling and include VAT where applicable.
- Payment for in-store purchases is due at the point of sale.
- Special orders may require a deposit, which will be stated at the time of ordering.
- Approved trade accounts are invoiced on agreed terms; late payment may attract statutory interest.
We accept the payment methods displayed in store at the time of purchase. We do not store full payment card details.
5. Fitting appointments and advice
Foot measuring and fitting consultations are provided free of charge and without obligation to purchase. Appointments are recommended but not required.
Our fitters are footwear specialists, not medical practitioners. Our advice concerns fit, construction and suitability of footwear only, and is not a diagnosis or medical treatment. If you have a diagnosed foot condition, prescribed orthotics or ongoing pain, please follow the guidance of your healthcare professional; we are happy to fit footwear around their recommendations.
If you cannot attend a booked appointment, please let us know so the slot can be released to another customer.
6. Repairs and restoration
- All repair work is quoted before it begins; we will not proceed without your approval.
- Estimated turnaround times are given in good faith and may vary with materials availability.
- We will advise you if, in our view, a repair is not economically worthwhile.
- Repairs to heavily worn, previously repaired or unusually constructed items are accepted at your risk, and we will explain any concerns before starting.
- Items left uncollected for more than 90 days after we notify you that work is complete may be disposed of, subject to any outstanding charges.
7. Trade and bulk supply
Trade arrangements — including on-site sizing days, agreed product shortlists, repeat ordering and account invoicing — are governed by these terms together with any written supply agreement between us. Where the two conflict, the signed supply agreement takes precedence.
Business customers should note that statutory consumer cancellation rights do not apply to trade orders. Bulk and specification-based orders may be non-returnable once production or supplier ordering has commenced; this will be confirmed in writing before we place the order.
8. Collection and delivery
Goods are ordinarily collected from our Brentwood store. Where delivery is arranged, we will confirm the method, cost and estimated timescale in advance. Risk in the Goods passes to you on collection or delivery.
Please inspect Goods on receipt and tell us promptly about any damage or shortage so we can resolve it quickly.
9. Returns, exchanges and cancellation
Consumers
Unworn Goods in their original condition and packaging, with proof of purchase, may be returned or exchanged within 30 days. Please try footwear indoors on a clean surface until you are certain of the fit — soles marked by outdoor wear cannot be accepted as unworn.
Where distance or off-premises selling rules apply, you have a statutory 14-day cancellation period beginning the day after you receive the Goods, and a further 14 days to return them. This does not affect your other legal rights.
Exclusions
- Goods made or modified to your specification, including stretched, dyed or altered footwear.
- Hygiene-sensitive items such as insoles and hosiery once opened or used.
- Completed repair work, except where the work itself is defective.
Refunds are issued to the original payment method, normally within 14 days of us receiving the returned Goods or evidence of return.
10. Product quality and manufacturer warranties
Goods supplied are of satisfactory quality, fit for purpose and as described, in line with the Consumer Rights Act 2015. Where a manufacturer offers a warranty, we will help you make a claim under it.
Warranties do not cover normal wear — including sole and heel wear, creasing, colour change from exposure to light, or damage from misuse, unsuitable conditions or incorrect cleaning. Footwear is a consumable product and its lifespan depends on how and how often it is worn.
11. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.
Subject to that, our total liability arising from any contract with you is limited to the price paid for the relevant Goods or Services. We are not liable for indirect or consequential loss, or for loss of profit, revenue or business opportunity, particularly in dealings with business customers.
We are not liable for delay or failure caused by events beyond our reasonable control, including supplier failure, transport disruption, extreme weather or utility outages.
12. Privacy and cookies
Personal data
We collect only the information we need to respond to enquiries, fulfil orders, provide fitting and repair services, and meet our legal obligations. That typically means your name, contact details, purchase history and, where relevant, foot measurements recorded to help with future fittings.
We do not sell your personal data. We share it only with service providers acting on our behalf, such as couriers and suppliers fulfilling your order, and where the law requires it. Records are kept only as long as necessary, and for the periods required for tax and accounting purposes.
Under UK data protection law you have rights of access, rectification, erasure, restriction, portability and objection. To exercise them, email enquiries@oakandsole.co.uk. You may also complain to the Information Commissioner's Office.
Cookies
This website uses strictly necessary cookies and browser storage to remember your cookie preference and keep the site working. Optional cookies, where used, help us understand how the site is used so we can improve it.
You may accept or decline optional cookies using the banner shown on your first visit. Your choice is stored locally in your browser. Clearing your browser storage will reset it and the banner will appear again. You can also block or delete cookies in your browser settings, though some parts of the site may then work less well.
13. Website use and intellectual property
All content on this website — text, layout, graphics, logos and the OAK & SOLE name — belongs to OAK & SOLE LTD or its licensors. You may view and print pages for your own non-commercial use. You may not copy, republish or exploit the content commercially without our written permission.
Photographs used on this site are licensed stock images included for illustrative purposes and may not depict our premises, staff or specific stock.
You agree not to misuse the site, attempt to gain unauthorised access, or introduce malicious code. Content is provided for general information; product availability, specifications and prices may change without notice.
14. Complaints
If something has gone wrong, tell us and we will put it right. Email enquiries@oakandsole.co.uk or call 07476 576773 with your name, order or repair reference and a short description of the issue.
We acknowledge complaints within one working day and aim to resolve them within ten working days, keeping you informed if a matter needs longer.
15. Changes to these terms
We may update these terms to reflect changes in our services, operations or the law. The version published on this page at the time you place an order or book a service is the version that applies to it. Please check the "last updated" date above.
16. Governing law and jurisdiction
These terms are governed by the laws of England and Wales, and disputes fall within the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you may bring proceedings in your local courts.
If any provision is found to be unenforceable, the remaining provisions continue in full effect.
